FoundriAI, Inc. ("Foundri") respects intellectual property rights and expects users to do the same. This policy explains how copyright works on Foundri, how to report infringement, and how we handle takedown and counter-notice requests under the U.S. Digital Millennium Copyright Act (DMCA).

1. Copyright Ownership Expectations

Business Owners and other users may upload photos, videos, product images, service descriptions, portfolio items, and other content to their public Foundri pages ("User Content"). You must own or have the necessary rights, licenses, or permissions to upload and display anything you publish on Foundri.

You are solely responsible for User Content you post. Foundri does not pre-screen uploads and does not endorse user content. If you are unsure whether you have the right to use material, do not upload it.

2. Reporting Copyright Infringement

If you believe content on Foundri infringes your copyright, please notify us promptly. You may:

Include as much detail as possible so we can locate the material, including direct URL(s) to the Foundri page or specific content in question (for example, foundri.me/username).

3. Required Information for a Valid DMCA Notice

To help us act on your report, a valid DMCA takedown notice should include:

  • Your physical or electronic signature (typing your full legal name in our form or email is acceptable).
  • Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  • Identification of the material you claim is infringing, with enough detail for us to locate it (URL(s) on Foundri).
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Counter-Notice Process

If your content was removed or disabled because of a copyright notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice to copyright@foundri.me. Your counter-notice should include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal (URL(s) on Foundri).
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which Foundri may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

If we receive a valid counter-notice, we may forward it to the original complainant. Unless the copyright owner files a court action seeking to restrain the user from engaging in the infringing activity, we may restore the removed content after a reasonable period, consistent with applicable law.

5. Repeat Infringer Policy

Foundri may terminate or restrict accounts of users who are repeat infringers, in appropriate circumstances. We maintain a record of valid copyright notices and may suspend or permanently disable accounts that accumulate multiple substantiated infringement claims. We may also take action on a first offense when warranted by the severity of the violation.

6. Foundri's Right to Remove Content

Foundri reserves the right to remove or disable access to any content, in whole or in part, that we reasonably believe infringes copyright or violates our Terms of Service, with or without prior notice. We may act on our own initiative or in response to a report. Removing content does not create any obligation to monitor other user content.

7. Good-Faith Submissions Only

Please submit DMCA notices and counter-notices in good faith. Knowingly submitting false or misleading claims may result in legal liability under 17 U.S.C. § 512(f). If you are unsure whether material infringes your rights, consider consulting an attorney before filing a notice.
